8KeysAcademy (“Company” or “We” and their connotations) operates the website [URL: www.8keysacademy.com] (together referred to as the “Platform”), which provides online piano tutoring services to users.
These Terms and Conditions (“Terms”) outline the terms under which the Company grants users access to the Platform (hereinafter referred to as “Services”) and must be read in conjunction with our Privacy Policy, available at [URL: www.8keysacademy.com]. Our Platform is designed for students of all age groups interested in learning piano through live, interactive online sessions with certified instructors.
Anyone under the age of 18 (“Child”) must have parental or guardian consent to use the Platform. The parents or legal guardians of the Child, as well as users above 18 years of age, are hereinafter referred to as “You”. The term “Users” shall collectively refer to both You and/or the Child.
 
1. Terms of Service
By choosing to visit and/or avail any services provided by 8KeysAcademy, you agree to these Terms (as may be updated from time to time). Please read the following information carefully. If you are a parent or guardian and you provide consent for your child's use of 8KeysAcademy’s services, you agree to be bound by these Terms on their behalf. By continuing to access or use our platform, you acknowledge and accept these Terms as legally binding. If you do not agree to these Terms, please discontinue the use of our services immediately.
 
2. Description of Services
8KeysAcademy provides online piano education to students worldwide. Our goal is to offer high-quality virtual music lessons taught by certified instructors. Through our platform, students can access structured lessons from the comfort of their homes, with no restrictions on time and location.
Our academy follows a structured curriculum designed to help students progress through different skill levels. Our expert tutors will guide students through their learning journey, providing personalized support and feedback.
To access our services, you or your child may be required to create an account and provide certain Personal Information, which may include but is not limited to 1. Name, email ID, and contact details 2. Photograph and location 3. Gender and other demographic information 4.Date of birth to verify the child's age 5.Email address of the child's parent or guardian for parental consent.
By registering for 8KeysAcademy, you acknowledge and agree to the collection and use of this information as outlined in our Privacy Policy.
 
3. License to Use
8KeysAcademy grants you and your child a limited, non-exclusive, and non-transferable right to access, view, and use our platform solely for the purpose of attending online piano lessons, accessing course materials and assignments, submitting student work and progress updates, making payments for classes or services, and utilizing any interactive features or services offered by 8KeysAcademy. We reserve the right, at our sole discretion, to suspend or deny access to any part of our platform if there is a violation of our terms. This license is strictly for personal, non-commercial use by you or your child. Any rights not explicitly granted remain the exclusive property of 8KeysAcademy.
 
4. Intellectual Property Rights
8KeysAcademy retains full ownership of all intellectual property rights, including copyrights, trademarks, patents, designs, logos, trade dress, trade secrets, know-how, and any other proprietary rights related to the content and services provided on our platform. This includes, but is not limited to, the curriculum, lesson materials, texts, graphics, photos, illustrations, applications, and logos. You are not permitted to copy, download, publish, distribute, or reproduce any content from 8KeysAcademy’s platform or social media without prior written consent.
If you choose to record any virtual piano sessions conducted by 8KeysAcademy, these recordings may only be used for personal reference and must not be shared on social media, distributed, or used for commercial purposes. Unauthorized reproduction or distribution of any content from 8KeysAcademy to third parties without explicit written permission is strictly prohibited. Any violation of these terms may result in legal action by 8KeysAcademy.
 
5. Linking
You may establish a link to the 8KeysAcademy website, provided that the link is legal, does not harm or exploit our reputation, and is not used for advertising or promotional purposes without our explicit consent. The link must not originate from any website that promotes political or religious views, intolerance, hatred, discrimination, violence, pornography, or any illegal activity. The link must not falsely suggest any endorsement or association with 8KeysAcademy. Framing of our website on another site or providing access to it under a different URL is not allowed.
8KeysAcademy reserves the right to withdraw permission to link to our website at any time without notice. Any links on our platform leading to third-party websites, web pages, resources, or mobile services are provided for informational purposes only. 8KeysAcademy is not responsible for the content, security, or functionality of third-party links, and accessing them is at your own risk.
6. Payment and Refund
8KeysAcademy offers its services based on the pricing plans selected by you on the platform. All payments must be made through the payment mechanisms provided by 8KeysAcademy, which may include card payments, net banking, EMI options, online bank transfers, UPI, and digital wallets. The payment gateway services are operated by third-party providers, and by making a payment, you agree to be bound by their respective terms and conditions as listed on the platform.
Payments made through valid credit/debit cards, online banking, or other payment instruments are processed securely through third-party gateways. The transaction terms are governed by agreements between you and the respective issuing bank or payment service provider. 8KeysAcademy is not responsible for any unauthorized transactions, fraud, failed payments, or refunds due to issues with the payment provider. Refunds, if applicable, will be limited to the amount paid for services that were not delivered.
Any free trials offered by 8KeysAcademy will also be governed by these terms. Free trials may require you to register a valid payment method before starting, and auto-renewal may be enabled unless canceled before the trial period ends.
 
7. User Content
8KeysAcademy allows you to submit, post, display, transmit, perform, publish, distribute, or broadcast content and materials, including but not limited to articles, commentaries, photographs, text, music, video, audio recordings, computer graphics, pictures, data, questions, comments, suggestions, or personally identifiable information. 8KeysAcademy reserves the right to remove any content at its discretion, subject only to its express obligations concerning peer-reviewed articles.
Users may choose to write and post reviews on the platform. However, we do not encourage the sharing of personal information, and any consequences of such disclosures will be the sole responsibility of the user. You may request 8KeysAcademy via email to delete any such information posted by you or your child. For verification purposes, the request will be reviewed and scrutinized before a response is provided.
By posting content, you warrant that it will not be misleading in any way, give a false impression regarding its origin or approval, be defamatory, plagiarized, abusive, malicious, threatening, false, misleading, offensive, insulting, discriminatory, harassing, racist, sexist, obscene, or otherwise inappropriate. Content must not breach confidentiality, privacy rights, or any legal obligations, nor should it prejudice ongoing or pending legal proceedings. Personal accusations or criticisms of 8KeysAcademy personnel, tutors, or reviewers are not permitted. Content must not infringe intellectual property rights of 8KeysAcademy or any third party, contain technically harmful elements such as viruses or malware, advertise or promote any products or services, request donations, or be considered spam or junk content. Impersonation of another person or misrepresentation of identity is prohibited. Any content violating laws, leading to civil liability, or breaching these terms will not be allowed.
8KeysAcademy is not responsible or liable for any user-generated content posted on the platform. Users must not attempt to bypass or undermine any security measures put in place by 8KeysAcademy. By using our services, you explicitly consent to the recording of video, audio, and images during sessions. These recordings are stored for internal quality management and auditing purposes. Additionally, as part of our training program, parents may upload videos showcasing student performances, which may be shared on social media or other platforms to highlight student progress. You also consent to 8KeysAcademy sharing such recordings with third-party service providers for performance evaluation or processing activities on our behalf. However, we will not share your personal information with third parties for their own use unless explicit consent is given.
8. User Communication
You explicitly consent to receiving communication from 8KeysAcademy via email, telephone, WhatsApp, or text message for the purpose of providing alerts and information about our services.
9. Rules of Conduct
Users must comply with the laws applicable in the location from which they access 8KeysAcademy’s services. If any laws restrict or prohibit access to or use of these services, users must adhere to those legal requirements or stop using the services. Users must ensure that all information provided to 8KeysAcademy is true, accurate, and complete at all times.
Users agree not to hack, attempt to hack, modify, adapt, merge, translate, decompile, disassemble, reverse engineer, or create derivative works from the service or any part of it. Users must not remove, disable, modify, add to, or tamper with any program code, copyright, trademarks, or other proprietary notices related to the service. Users must not create software that mimics any data or functionality of the service or use it beyond what is permitted by these terms.
Users must not include contact details for external communication, send unsolicited bulk emails, make commercial use of the service, or provide links or access to the service for profit or gain without prior written permission from 8KeysAcademy. The service must not be accessed for illegal or immoral purposes, and users must not delete or obscure copyright or proprietary notices.
The service can only be accessed through authorized servers. Users must not attempt to bypass authorized servers or use third-party software to modify any aspect of the service to gain an unfair advantage. 8KeysAcademy reserves the right to monitor users’ access to ensure compliance with these terms.
10. Limited Liability
You are personally liable for any violation of a third party's rights by you or your child. You agree to reimburse 8KeysAcademy for all damages resulting from any breach of these terms. Users release 8KeysAcademy from any claims by other users or third parties due to content posted by the user or violations of any obligations. You shall bear the cost of 8KeysAcademy's legal defense, including all court and legal fees, unless you are not responsible for the infringement.
8KeysAcademy ensures that the information and training provided by tutors on the platform is accurate but does not guarantee its correctness, completeness, or suitability for any specific purpose. The company is not responsible for the information and guidance provided by tutors. While 8KeysAcademy expects professional conduct from tutors, it will not be liable for any unprofessional actions by individual tutors. The company does not provide any warranty regarding the quality of lectures delivered by tutors on the platform.
The company reviews the curriculum delivered by tutors but does not guarantee the quality of lessons. In any live interactive class, if a tutor uses inappropriate language, depicts forced sexual acts, or shows explicit images, you must immediately report it to 8KeysAcademy at the contact provided in Clause 17. The company will take all necessary actions as per applicable law but explicitly disclaims liability for such incidents.
8KeysAcademy is not responsible for any unethical or illegal actions performed by a child based on a tutor’s advice. It is the responsibility of parents to monitor their child’s activities while using the platform.
Under no circumstances shall 8KeysAcademy be liable for any direct, indirect, incidental, special, or consequential damages, including loss of profits, revenue, or data. The company provides educational services on an "as-is" basis and is responsible only for delivering its services with reasonable skill and care. The company’s total liability for all claims related to the platform shall not exceed the amount actually paid by the user for services.
External sites linked through the platform have not been reviewed by 8KeysAcademy, and users access them at their own risk. The company makes no warranties regarding external sites and excludes liability for any loss or damage caused by them.
8KeysAcademy does not guarantee that the platform will operate without interruptions or errors. The company will not be liable for failure to perform any obligation due to unforeseen circumstances beyond its control, including internet outages, communication failures, natural disasters, or war.
Users must not conduct themselves in an unlawful manner that could bring disrepute to 8KeysAcademy. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
 
11. Third-Party Permission
8KeysAcademy has partnered with various third-party service providers, and by accepting these terms, you explicitly grant permission for these service providers to use your information and contact you regarding our services, even if your mobile number is registered under the ‘Do Not Disturb’ mode. In the event of any dispute between you and a third-party service provider, 8KeysAcademy shall not be held liable in any manner.
12. Amendments to Terms
8KeysAcademy reserves the right to modify these Terms under the following circumstances: (a) changes in legal regulations, (b) decisions by the Supreme Court, (c) technical requirements, (d) operational necessities, (e) market conditions, and (f) improvements for the benefit of users. Any amendments will not disrupt the contractual balance between the parties. Users will be notified of any changes via the platform, email, or written notice.
13. Termination
8KeysAcademy reserves the right to remove, restrict, cancel, or suspend access to its services if it determines, at its sole discretion, that you have violated these Terms. You may also terminate your agreement with 8KeysAcademy by discontinuing access to the platform and deleting all related content within your control. Termination will not affect any rights or remedies that have accrued before the termination date.
14. Indemnity
You agree to indemnify and hold harmless 8KeysAcademy, its contractors, licensors, and respective directors, officers, employees, and agents from any and all claims, expenses, including attorneys' fees, arising from your use of the Services and/or the Platform, including but not limited to violations of these Terms.
15. Severability
If any court or competent authority determines that any provision of these Terms is invalid, illegal, or unenforceable, such provision shall be deemed removed to the extent necessary, and the validity and enforceability of the remaining provisions shall not be affected.
16. Assignment
Your rights and licenses under these Terms shall not be transferred or assigned by you, but 8KeysAcademy may assign its rights and obligations at its sole discretion. Any attempted transfer or assignment in violation of this provision shall be null and void.
17. Waiver
No waiver of any provision of these Terms shall be considered a further or continuing waiver of such provision or any other provision. The failure of 8KeysAcademy to assert any right or enforce any provision shall not constitute a waiver of such right or provision.
18. Governing Laws
These Terms shall be governed and construed in accordance with the applicable laws of India. In case of any conflict between the laws of India and the country of residence of the user, Indian laws and courts shall prevail.
19. Dispute Resolution
Any dispute arising from the interpretation or execution of these Terms that cannot be resolved amicably within 60 days of written notice shall be referred to arbitration. A sole arbitrator shall be appointed by mutual agreement. If the parties fail to reach a consensus, each party shall appoint its own arbitrator to form a three-member arbitral tribunal. The arbitration shall be conducted in accordance with the Arbitration and Conciliation Act, 1996. The arbitration venue shall be Bangalore, India, and the language shall be English. The cost of arbitration shall be shared equally by both parties, and the arbitrator’s decision shall be final and binding.
